:O R D E R
This revision is filed against the order of dismissal of the
application to send the signature found in the promissory note and compare it
with the signature found in the affidavit filed in the Court which was made
more than two years after the execution of the promissory note.
2. The District Munsif, Perambalur has stated that a disputed
signature is to be compared with any other signature which is contemporaneous
to the date on which the disputed signature was made and a signature which is
not contemporaneous, cannot be compared with.
3. Since, in this petition, there is a specific direction to compare
the signature put by the petitioner in the affidavit filed by him in the suit,
the learned District Munsif has rightly rejected this claim. There is no
illegality in this order.
4. Hence, the revision is dismissed. Consequently, C.M.P.4388 of 200
3 is closed.
