The petitioner apprehends arrest in Teghra P.S. Case No.

144 of 2009 under Sections 302 and 201/34 of the Indian Penal

Code.

The petitioner is the mother-in-law of the deceased.

Learned counsel for the petitioner submits that the

petitioner is an old lady aged 70 years. It is also submitted that the

main allegation is against the husband of the deceased who said to

have assured several times that torture and harassment will not be

done to the deceased but it was done. It is also submitted that there

is no eye witness to the occurrence and that the deceased was under

treatment in a hospital who died during treatment and vide

Annexure-2 death certificate granted by the doctor has been filed.

Learned counsel further submitted that co-accused Chunchun Devi

the gotni of the deceased whose case was similarly situated has

already been allowed bail by a Bench of this court vide order dated

14.6.2010 passed in Cr. Misc. No. 20039 of 2010.

In the facts and circumstances of the case, in the event of

her arrest/surrender before the court below within a period of three

weeks, she (Chinta Devi) is admitted to bail on furnishing bail bond

of Rs. 10, 000/- (ten thousand) with two sureties of the like amount

each to the satisfaction of Chief Judicial Magistrate, Begusarai, in

Teghra P.S. Case No. 144 of 2009, subject to the condition as laid

down under Section 438(2) of the Code of Criminal Procedure.
