		Heard learned counsel for the parties.

2. It is contended on behalf of the appellant that looking to the short term of sentence, the learned trial court itself has suspended the sentence of the appellant for one month, therefore, the sentence of imprisonment awarded by the trial court be suspended during pendency of the appeal.

3. After considering all the facts and circumstances of the case, but without expressing any opinion on merits and demerits of the case, I am inclined to allow this application and the same is hereby allowed.

4. It is directed that sentence of imprisonment of appellant namely Chothmal S/o. Sanwalya passed by Special Judge, Electricity Crimes, Sawaimadhopur vide impugned judgment dated 23.06.2011 in Criminal Case No. 02/2010 shall remain suspended during pendency of this appeal and he shall be released on bail provided, he furnishes a personal bond in the sum of Rs. 50,000/-(Rupees Fifty Thousands) with two sureties of Rs. 25,000/-(Rupees Twenty Five Thousands) each to the satisfaction of the trial court to appear before this Court on 16.08.2011 and as and when he is called upon to do so.
