Heard learned counsel for the petitioner.
The sole grievance of the petitioner is that the application filed by him
seeking temporary injunction is pending disposal since 3rd March 2009, even
though this court while deciding writ petition no.60084 of 2000 along with
other connected writ petitions on 16.2.2009 between the parties while
relegating to the alternative remedy in the suit had directed the suit to be
decided expeditiously preferably within a period of six months and even after
expiry of a year neither the suit has been decided nor the application has been
decided.
Considering the facts and circumstances, Civil Judge (S.D.), Jaunpur is
directed to decide the application paper no.25Ga/1 within a period of one
month from the date of presentation of the certified copy of the order before
him in accordance with law. The Civil Judge (S.D.), Jaunpur shall also
comply with the order dated 16.2.2004 passed by this Court in Writ Petition
No.60084 of 2000 along with other connected writ petitions, failing which he
may be liable to be prosecuted for contempt.
The writ petition is accordingly disposed of.
