Having heard learned counsel for the parties, we are of the view that
considering the order passed in Special Appeal No. 1673 of 2009 (C/M
Shri Narain Sinha Inter College Sarai Harkhu Thru’ Manager Vs. Prem
Chandra Dubey & Ors.), the order impugned deserves to be set aside.

Accordingly the impugned judgment and order dated 14.6.2010 is set
aside and the Writ Petition No. 34757 of 2010 is restored back to the
learned Single Judge for reconsideration along with Writ Petition No.
50600 of 2009.

With the above observation the special appeal is disposed of.
