Mr. M. B. Singh, who has put in appearance on behalf of the Registrar,
submits that on account of non-appearance of the parties before him,
the matter is lingering. Further, he states that as and when the case is
fixed by the Registrar, it has been informed to him that the matter is
pending before the High Court and as such, the case may be adjourned.
Next, he states that Uchattar Madhyamik Vidyalaya Samiti is a Society
registered under the Societies Registration Act in the year 1986 vide
Registration No. 1226/86-87 dated 28.6.1986 and another Society under
the name of Higher Secondary Schools Society, Sultanpur has been
registered vide registration No. 687/02 dated 30.10.2001. According to
him, one institution has been named in Hindi version, whereas the other
institute has been named in English Version. As the dispute is pending
before the Deputy Registrar, Societies, Chits and Funds, Faizabad and
the matter requires evidence it cannot be adjudicated, learned Counsel
for the Registrar states that in case all the parties cooperate, the matter
can be adjudicated within 15 days.
Since it requires evidence and the matter cannot be adjudicated under
Article 226 of the Constitution of India, one month time is granted to the
Deputy Registrar to decide the matter with regard to the name of the
institution, latest by 20.8.2010. Further, the Deputy Registrar is directed
to fix a date within one week and the same shall be communicated to all
the parties on the registered addresses as well as by means of
notification.
List this matter on 25.8.2010 on which date, Mr. M. B. Singh, learned
Standing Counsel shall produce the order passed by the Deputy
Registrar. He shall also produce the records on the next date of listing,
which are available with him today.
