learned AGP Mr. AL Sharma on behalf of applicant, learned advocate
Mr. SN Soparkar with learned advocate Mr. AN Bhatt appearing on
behalf of original petitioner and learned advocate Ms. LK Bhaya
appearing for respondent.

I
have considered submission made by both learned advocates and
averment made in present application. I have also considered
affidavit in reply filed by respondent no. 2 Chhatrasinh Parmar, S/o
Ambelal Parmar, Executive Engineer of D.G.V.C. L. para 5 and also
considered interim relief granted by this Court in favour of
petitioner in terms of para 7(B)(i) as well as considering order
passed by this Court on 25/6/2010.

In
light of this entire back ground, respondent state authority require
some more time to decide it as per direction issued by this Court.
Therefore, time is extended as prayed by applicant in para 6(A) for
a period of 4? month. Meanwhile, let sincere efforts to be made by
respondent to finalize issue which has been required to be decided
by respondent in pursuance to direction issued by this Court.

Accordingly,
time is extended for 4? months from date of which, it has come to
an end. In view of above observation and direction, present civil
application is disposed of by this Court.
