The case was taken up but the counsel for the Commission Sri S.R. Singh
whose presence was necessary for the purpose of disposal of the case, is not
present. As such, Sri A.K. Yadav who is also one of the counsel for the
Commission, is directed to seek instructions in the present case and to file a
specific affidavit in view of the allegations made in para 7 of the affidavit
filed by Sri Shiv Nath Saroj dated 27.11.2009 specifically stating therein that
whether any opinion by the Commission was ever received directly or
indirectly by the Committee of Management regarding approval of the action
taken against respondent no.3.
