Heard learned counsel for the petitioner and the learned
standing counsel.
The matter is of transfer. The writ petition was filed in the
year. 2007 Interim order maintaining the status- quo was
passed on 27.7.2007. Three years have passed. It has to be
taken note of the fact that when an interim order is passed in
the matter of transfer, that can not be allowed to continue for
years together. As the transfer orders are effected at the time
of annual transfer and therefore, once the transfer is stayed
normally the interim order may be supposed to remain in
force for the entire year but it may not continue beyond that
unless specific order is passed.
The petition is finally disposed of with the direction that the
opposite parties shall be at liberty to consider the case of the
petitioner for transfer, if need be, in the annual chain of
transfers.
