Heard learned counsel for the parties and perused the record. The attention of
the Court was drawn to a judgment rendered by this Court on 20.3.2008 in
writ petition No.15013 of 2008- K.B.Pandey Vs. State of U.P.&others.
Learned Standing Counsel has submitted that the petitioners are out of zone of
eligibility for promotion on the post of head constable. They had not obtained
required marks. Upon this learned counsel for the petitioner submitted that
several irregularities were committed in the selection process.
After hearing learned counsel for the parties, this Court is of the view that this
Court cannot act as a super selection Board or sit in appeal against the
decision taken by the Selection Boards of the police department for
considering the case of constables for promotion on higher post. However, if
the petitioners have any grievance, it is open for them to submit a
representation to the appropriate authority of the department. If such a
representation is made, the same may be considered and disposed of in
accordance with law . With these observations, the writ petition is disposed
of.
