                     JUDGMENT

1.The petitioner took voluntary retirement from the

service of the respondent on 31.7.2009. On

6.8.2009, i.e., hardly six days after his

retirement, he has filed this writ petition

seeking a direction for out of turn payment of

retiral benefits in connection with the marriage

of his daughter which is pleaded to be arranged

for being held on 21.1.2010.

2.On this first adjourned posting, learned counsel

for the respondent does not have specific

instructions. Obviously, the veracity of the

arrangement for the marriage is a matter that has

to be considered on proper verification by the

KSRTC. A person, who has retired voluntarily, is

not one to whom any out of turn payment is to be

given in the normal circumstances. But, the

petitioner, going by his affidavit, is now 53

years old.

Taking all relevant facts, it is ordered that if

the KSRTC is satisfied of the bonafides of the

plea regarding the proposed marriage of the

petitioner’s daughter, one half of the DCRG and

CVP as may be found due to the petitioner shall

be released in the second week of January, 2010.

The writ petition is allowed to the aforesaid.
