2 23.09.2010 Heard learned counsel for the petitioner and Additional
P.P. for the state. Petitioners are named accused in this case carry
allegation of helping their own brother non-petitioner, Pandav Kumar
Yadav in kidnapping of minor daughter of the informant who as per
the petitioners on the basis of one transfer certificate no.60 sought to
have been issued on 2.1.2004 by the Headmaster, Adarsh Madhyamic
Vidyalaya, Maheshpur, Mirzan Hat, Bhagalpur – 5, showing date of
birth of victim Rubi Kumari daughter of Sri Raas Bihari Mishra and
Bindu Devi is 12.2.1992. Affidavit has also been filed showing that
the victim and non-petitioner Pandav Yadav have been married on
19.04.2010 at Gayatri Mandir, Khagaria.
Considering the facts and circumstances of the case, in the
event of his arrest / surrender before the court below within four
weeks of receipt of the copy of this order, petitioners no.1. Dablu
Yadav, 2. Sikki Yadav, 3. Nikki Yadav and 4. Kabbo Yadav, are
directed to be released on bail on furnishing bail bond of Rs.10,000/-
each with two sureties of the like amount each to the satisfaction of
the C.J.M., Bhagalpur, in Jagdishpur P.S. Case No.48 of 2010, subject
to the conditions as laid down under section 438(2) of Cr.P.C. with
additional condition to remain physically present before the learned
court below on each and every date at least for one year or till disposal
of the case whichever is earlier, in case of failure on two consecutive

dates, the liberty shall be deemed to be cancelled.
