learned Advocate, Mr. Asit B. Joshi appearing on behalf of appellant
and learned Advocate, Mr. K.M. Sheth appearing on behalf respondents
No.1/1 to 1/4.

When
matter has been taken up for hearing by this Court, both learned
Advocates have submitted that respective parties of First Appeal
have settled the matter outside the Court in writing dated
01.02.2010. They also submitted that this settlement may be taken
on record and ad-interim relief which is operating may be vacated.

Considering
submissions made by both learned Advocates and also considering
consent terms arrived at between the parties in writing dated
01.02.2010, First Appeal is disposed of accordingly. Ad-interim
relief which is operating stands vacated.

Today
first appeal has been disposed of by this Court on basis of consent
terms arrived at between the parties. Therefore, Civil Application
No.11127/2008 does not survive. Accordingly this is also disposed
of. Direct Service is permitted.
