Heard learned counsel for the appellant and learned AGA on bail prayer of the
appellant.
Learned counsel for the appellant contended that the incident occurred in the
heat of passion after alteration without any intention to murder. Learned
counsel further contended that the offence will not travel beyond the scope of
section 326 IPC. Learned counsel further contended that the appeal is not
likely to be heard in near future. The appellant is in Jail since about two years.
Without expressing any opinion on merits of the case, I consider it appropriate
to release the appellant on bail.
Let the appellant Deepak be enlarged on bail on his furnishing a personal
bond of Rs. 1 lac with two sureties each in the like amount to the satisfaction
of trial Judge concerned in S.T. No. 119/06, Crime No. 1170/02, u/s 307 IPC,
P.S. Kotwali, district Mainpuri.
As soon as bail bonds and surety bonds are furnished, photocopies of the
same are directed to be transmitted to this Court forthwith by concerned Court
to be kept on the record of this appeal.
The appellant is allowed one month time to deposit entire amount of fine
awarded on him by the trial court.
