Heard learned counsel for the applicant and learned A.G.A. appearing
for the State.
It is contended by the learned counsel for the applicant that the
applicant is Dewar of the deceased. There is general allegation
against him and he has been falsely implicated in this case. No
overtact has been assigned to him.
Learned A.G.A. contended that the applicant along with co-accused
was involved in committing the murder of the deceased.
Applicant is Jeth of the deceased. No overtact has been assigned to
him.
Considering the facts and circumstances of the case and submissions
made by the learned counsel for the applicant and without expressing
any opinion on the merits of the case, the applicant is entitled to be
released on bail.
Let the applicant Deepu involved in Case Crime No. 202 of 2009
under Sections 498-A, 304-B IPC & Section 3/4 D.P.Act, Police
Station Jaitpura District Varanasi be released on bail on his
furnishing a personal bond with two sureties each in the like amount to
the satisfaction of the court concerned.
