The
present application is for condonation of delay of 1530 days in
preferring appeal against the judgement and the award passed by the
Reference Court which is impugned in the First Appeal.

Mr.H.B.Patel,
learned counsel appearing with Mr. Soni for all the original
claimants state that the claimants have no objection if the delay is
condoned and Mr.Soni, learned AGP for the respondent No.3 is the
supporting respondent.

Considering
the facts and circumstances and in view of the grounds stated in the
application for condonation of delay and the peculiar circumstance,
that on behalf of the respondents, there is no objection if the
delay is condoned, the delay deserves to be condoned and therefore,
condoned.

Application
allowed to the aforesaid extent. Rule made absolute accordingly.
