ORDER
The
applicant prisoner has preferred this application through jail for
temporary bail for treating himself for heart ailment. The applicant
has produced certificate in support of his application issued by the
Medical Officer, Central Jail Dispensary, Ahmedabad dated 25.5.2010.
Said certificate indicated that TMT is negative for exercise
induced. Said opinion reads as under :
TMT
is negative for exercise induced and ischaemia at high workload.
In
the overall facts and circumstances of the case and the fact that
the prisoner is being treated, I am of the opinion that at present
the accused need not be enlarged on bail. It is however, appropriate
to issue directions to the Jail Authorities for taking care of the
accused as under :
i)
The Jail Authorities should be vigilant in attending to the
complaints by prisoner in respect of chest pain and/or other
ailments.
ii) On
receipt of such complaints from the prisoner, immediate medical
attention be provided to him and if need, should be taken to the
nearest hospital without fail.
iii) Prisoner
may be prevented from undertaking arduous tasks or any hard working
which may aggravate his medical condition.
iv)
Medical officer should regularly examine the prisoner.
These
directions are suffice for taking care of the situation as on date.
Rejection
of this application would not in any way debar the applicant to make
appropriate application in case, circumstances so warrant hereafter.
Rejection
of this application may be intimated to the prisoner immediately
with copy of this order to the Jail Authorities for making the
aforesaid compliance of the order issued by this Court.
Application
stands disposed of accordingly.
