Heard Mr. Sanjay Srivastava, learned counsel for the petitioner, learned AGA
for the State and perused the record.
Issue notice to respondent no. 2, who may file counter affidavit within four
weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List immediately after expiry of the aforesaid period.
By the next date of listing the operation of the impugned order dated
10.6.2008 passed by the C.J.M. Auraiya, in Case No. 417 of 2007, shall
remain stayed provided the revisionist pays all the due amount till September
2010 calculated at the rate as ordered by the trial court from the date of the
order i.e. 10.6.2008 by 30.9.2010 and continues to pay the same by 7th day of
each month from October 2010.
The amount so deposited by the revisionist may be withdrawn by respondent
no. 2.
