Heard learned counsel for the appellant and learned AGA.
It has been argued by learned counsel for the appellant that
actually this is a matter of honour killing as the deceased wanted to
marry with the appellant Dhanveer. Both, the parents opposed the
proposal and she had been murdered. It has been argued by learned
counsel for the appellant that the appellant is in jail for the last 11
years and the case would not travel beyond Section 304 IPC.
It has been argued by learned AGA that the appellant after
murdering the deceased, consumed poison and was found on the
spot.
We find that Kamlesh (P.W.-2) was present at the spot. The
appellant was not on bail during trial. Direct role has been
assigned to the appellant.
We do not see any good ground to enlarge the appellant on bail.
His bail prayer is refused. However, in the facts and circumstances
of the case, the hearing of the appeal is expedited.
Office to prepare the paper books preferably within a period of
three months and to list the appeal for hearing soon thereafter
before the appropriate Bench.
