2. 02.08.2010. Heard learned counsel for the

petitioners and counsel appearing for the

State.

The petitioner no.1 being the agnate of

the informant and petitioner nos. 2 and 3 being

the workmen of petitioner no.1 are apprehending

their arrest in a case registered under

Sections 341, 323, 380 and 34 of the I.P.C.

It is submitted by the learned counsel

for the petitioners that ancestral lands are

being disposed off by the informant beyond his

share and on protest being made the present

false case has been lodged.

It is further submitted that initially

the supervising officer found the case false

but subsequently the superior officer did not

agree with the same. It is further submitted

that the informant has serious criminal

antecedent which has been mentioned in

paragraph no. 10 of the present application.

The petitioners have no criminal antecedent.

Considering the background in which the

present case has bee lodged by the informant

who is an accused for the murder of his uncle,

let the petitioners, Dharmendra Singh, Ramesh

Sah @ Ramesh Kumar and Soman Sah, be released

on bail in the event of their arrest or

surrender before the learned court below within

a period of twelve weeks from today in

connection with Triveniganj P.S. Case No.180 of

2009 on furnishing bail bond of Rs. 10,000/-

(Ten Thousand) each with two sureties of the

like amount each to the satisfaction of the

learned C.J.M., Supaul, subject to the

conditions as laid down under Section 438(2) of

Cr. P.C.
