ORDER
1. Heard
learned advocates appearing for the parties.
2. The
petitioner has filed this petition for withdrawal of this Special
Criminal Application, in view of an amicable settlement arrived at,
by consent terms in Suit No.78/2007 under Guardianship and Ward Act
at the High Court of Bombay, Maharashtra and order dated 21st
July, 2008 passed in terms of consent terms by the learned Judge
(Coram: Hon’ble Justice Smt. Roshan Dalvi) in Guardianship Petition
No.78 of 2007.
3. This
petition is signed by both the parties and the advocate of respondent
Nos. 2 and 3.
4. In
view of the above, there shall be an order in terms of the
application for withdrawal of this Special Criminal Application and
this application is taken on record and marked as X for
identification along with the order dated 21st July, 2008
passed in Guardianship Petition No.78 of 2007, which is ordered to be
taken on record.
5. Both
the parties agree with the consent terms filed in the Guardianship
Petition No. 78/2007 before the High Court of Judicature at Bombay
and the same shall govern the field and subject matter of the
petition, they shall adhere to consent terms and conditions for
welfare and interest of the child and shall maintain cordial family
relationship.
6. Considering
the above aspects and at the request of learned advocate appearing
for both the parties, Special Criminal Application No.1076/2008 is
permitted to be withdrawn and order accordingly.
7. The
petition stands disposed of. Notice is discharged. No order as to
costs.
