JUDGMENT
Petitioner
requests for release of his passport temporarily to visit Bangkok
for business purpose. The court below refused such permission.
Hence he has filed this petition. During the pendency of the
petition, the period for which the request for passport was made has
already started. Counsel for the petitioner therefore submitted that
the passport be released for a period of two weeks between 10th
March and 24th March 2010.
Having
heard the learned advocates for the parties, I find that the brother
of the petitioner who is also involved in some offence has also been
given such liberty. The petitioner has other family members and
business interests as well as properties in India, as stated by the
counsel.
Under
the circumstances, passport of the petitioner shall be released for
a limited period for traveling to Bangkok between 10th
March and 24th March 2010 on the following conditions:
He
shall execute bond and shall give bank guarantee of Rs.1 lac
(Rupees one lac) to the court below;
he
shall use his passport only for traveling to Bangkok between 10th
March and 24th March 2010;
he
shall give full itinerary of the tour before the court below;
he
shall surrender the passport immediately upon return;
that
this order does not mean that other travel requirements under law
are waived.
The
petition is disposed of in above terms. Rule is made absolute
accordingly.
