3 26.03.2011 Heard learned counsel for the petitioners as well as
learned counsel for the state.
Learned counsel for the petitioners seeks permission
to make necessary correction in his application and accordingly,
he is permitted to make necessary correction in the prayer
portion of the application during course of the day.
It is stated that petitioners alongwith other FIR named
persons went at the house of the deceased and thereafter, the
deceased left his home in the company of petitioners and other
accused and, subsequently, his dead body was found.
Admittedly, none of the person has seen the actual
killing of deceased and the petitioners have been named in this
case on the basis of above-said materials.
Considering the aforesaid facts and circumstances of
the case as well as submission of the parties, let the petitioners,
namely, Dilip Singh @ Dilip Kumar Singh and Binod Singh @
Binda be released on bail on furnishing bail bond of Rs 10,000/-
(ten thousand) with two sureties of the like amount each in
connection with Sessions Trial No. 39 of 2010 arising out of
Sanhaula P.S. Case No. 56 of 2010 to the satisfaction of
Additional Sessions Judge-IVth, Bhagalpur.
