1. Civil
Application No. 7139 of 2011 is filed for condonation of delay in
filing First Appeal and Civil Application (Stamp Number) 5386 of
2011 is filed for bringing heirs of the deceased appellant on
record.
2. Considering
the facts and circumstances of the case and without prejudice to the
rights and contentions of the parties, the delay in preferring the
First Appeal is condoned and the applicant is permitted to bring
legal heirs on record of the deceased Jayantibhai Patel. Both these
applications are disposed of accordingly.
