3. 07.07.2010. Heard learned counsel for the

petitioner and the State.

The petitioner being the brother-in-law

(Bhaisur) of the complainant is apprehending

his arrest in a case registered under

Sections 323, 504,406, 498A of the I.P.C. and

Section ¾ of the Dowry Prohibition Act in

which cognizance has been taken.

It is alleged that there was a demand

of Rs. 50,000/- and a cow and in pursuance to

the demand a cow worth of Rs. 15,000/-was

provided.

It is submitted by the learned counsel

for the petitioner that the petitioner is

partitioned from the husband of the

complainant and resides separately and

maliciously his name has been roped in the

present case after 11 years of the marriage.

From the impugned order, it appears

that the aforesaid grounds were taken before

the court below also.

Considering the aforesaid submissions

of the learned counsel for the petitioner,

let the petitioner, Dinanath Pathak, be

released on bail on his surrender before the

learned court below within a period of twelve

weeks from today in connection with complaint

case no. 1632C of 2008 on furnishing bail

bond of Rs. 10,000/-(Ten Thousand) with two

sureties of the like amount each to the

satisfaction of the learned S.D.J.M.,

Begusarai,, subject to the conditions as laid

down under Section 438(2) of the Code of

Criminal Procedure.
