PRAYER

Writ petition filed under Article 226 of the Constitution of India,
praying to issue a writ of mandamus, to direct the respondents to instruct
police parties, who are all approaching the members of the petitioner's
association in the name of enquiry, preventing them from harassing the
petitioner's members and observe most courtesy while dealing with the jewelers
and consequently, directing the police parties to abide the directions issued by
the Government of Tamilnadu in G.O.No.1416, dated 22.10.1999, by considering the
representations given by the petitioner dated 10.10.2008.

:ORDER

This writ petition has been filed to direct the respondents to instruct
the police parties, who are all approaching the members of the petitioner’s
association in the name of enquiry, not to harass the members of the
petitioner’s Sangam and observe most courtesy while dealing with the jewelers
and consequently direct the police parties to abide the directions issued by the
Government of Tamilnadu in G.O.No.1416, dated 22.10.1999, by considering the
representation given by the petitioner dated 10.10.2008.

2. Heard the learned counsel for the petitioner and also Mr.D.Sasikumar,
learned Government Advocate, who took notice on behalf of the respondents.

3. The grievance of the petitioner’s Sangam as aired by the learned
counsel for the petitioner placing reliance on the averments in the affidavit
accompanying the writ petition, is to the effect that in Dindigul area, the
jewelers are kept under tenderhooks, because of the arbitrary action in seizing
gold jewels and ingots under the pretext of seizing stolen articles and that too
without adhering to the mandates of the Government of Tamil Nadu in G.O.No.1416
dated 22.10.1999. Hence, this writ petition.

4. Heard the learned Government Advocate.

5. Hence, in these circumstances, the following direction is issued:
The respondents 2 and 3 shall see that the G.O.Ms.No.1416 dated 22.10.1999
is followed in letter and spirit by the police in the process of investigation.

6. With the above direction, this Writ Petition is disposed of. No costs.
