ORAL ORDER

It
is not clear as to why the applicant has sought for leave to appeal
against the order passed by the learned Single Judge on 29.6.2011 in
Special Civil Application No.16108 of 2010 etc. If the applicant has
been prohibited from running a sugarcane juice stall, the applicant
could have challenged the order by which he was prohibited. There is
nothing on the record to suggest that the learned Single Judge by
aforesaid order passed any order to affect the livelihood of the
applicant.

2. Under
the circumstances, while we do not grant any leave to appeal against
the said order, we make it clear that this order shall not stand in
the way of the applicant to challenge the order by which he has been
prohibited from running sugarcane juice stall at Bus Depot, Valsad.

3. The
civil application stands disposed of.

4. In
view of the aforesaid order, no further order is required to be
passed in the Letters Patent Appeal. Both the Letters Patent Appeal
and Civil Application for stay stand disposed of.
