2. 26.10.2010 Mr. Ashok Kumar Mishra, learned Counsel for the

petitioner is permitted to withdraw the application with regard

to petitioner no.1.

It has been submitted that from the perusal of the

agreement, it appears that the petitioner no.2 is nowhere in

the picture.

Issue notice to the opposite party no.2 to show

cause as to why the application be not admitted/disposed of

at the stage of admission itself, for which requisites etc.

under registered cover with A/D as well as ordinary process

must be filed within 10 days, failing which this application

shall stand rejected without further reference to a Bench.

Rule returnable three months.
