Rule.

Learned advocate Mr. B.A.Shaikh for learned advocate Mr.Sukhwani
appearing for the respondent waives service of notice of Rule.

Heard
learned advocate Ms.Acharya appearing for the applicants and learned
advocate Mr.B.A.Shaikh for learned advocate Mr.Sukhwani appearing for
the respondent.

The
application is taken out by applicant-panchayat who was by the order
dated 4/3/2010 directed to deposit the amount as per the Trial
Court’s order.

Present
application is taken out seeking extension of time for depositing the
amount as directed by the Court.

Learned
advocate Ms.Acharya for the applicants has submitted that the
principal amount which was to be deposited has already been
deposited, however, for want of funds, the applicants could not
deposit the interest amount. Therefore extension of time is
requested for. She has also submitted that the amount of interest
comes to about rupees eight lakhs. She further submitted that now
the cheque for the payable amount is ready and if the extension to
deposit the amount is given the same will be deposited immediately.

Learned
advocate Mr B.A.Shaikh for learned advocate Mr.Sukhwani has submitted
that the opponent has no objection if the extension of time is
granted.

Having
regard to the aforesaid submissions and the request for time to
deposit the balance amount, the application is allowed. The time to
deposit the balance amount is extended until 30/10/2010. Rule is
made absolute accordingly.
