1. Learned counsel appearing on behalf of the petitioner has
submitted that in similarly situated matter, order has been passed by
this Court, dated 10th July, 2008, in W. P. (S) 6595 of 2005
(Annexure-‘3’ to memo of petition) and submitted that similar order
may kindly be passed. The present petitioner is seeking arrears of
salary, non-practising allowance. The petitioner is an M.B.B.S. Doctor.
2. Mr. P. P. Roy, J. C. to S.C.I, has submitted that they have no much
objection, if the direction is given (as given in earlier matter at
Annexure-‘3’, ) to the respondents and the matter may kindly be
decided, in accordance with law.
3. In view of these submissions, the petitioner is permitted to make
fresh representation before the Secretary, Health, Medical Education &
Family Welfare Department, Jharkhand, Ranchi. If such representation
is filed, the Secretary shall consider the representation, in accordance
with law, rules, regulations, policy and Government enforceable order,
applicable to the petitioner and after giving adequate opportunity of
being heard to the petitioner or to his representative. The
representation of the petitioner will be decided, in accordance with
law, within a period of six weeks, from the date of receipt of such
representation. The petitioner is permitted to present before the
Secretary all the necessary documents upon which the petitioner is
relying upon, over and above, what is stated in this writ petition.
4. In view of the aforesaid submissions, this writ petition is disposed
of.
