21. 17.10.2011 Vide Order, dated 13.10.2011, the Principal
Secretary, Department of Health and Medical Education,
Government of Bihar, Patna was directed to remain
physically present in Court.
Today, when the matter is taken up, I. A. No.
7181 of 2011 has been filed on behalf of Opposite Party
No. 2, Principal Secretary, Department of Health and
Medical Education, Government of Bihar, that on
account of his training program at abroad, he is not in
India, as such unable to appear before the Court.
Incharge, Principal Secretary, Department of Health and
Medical Education has also gone to Delhi in connection
with some of the meeting of his own Department, i.e.,
Labour Department.
Prayer is for modification of Order, dated
13.10.2011 and for extending the date of physical

appearance of Opposite Party No. 2.
Interlocutory Application is allowed.
This matter is fixed on 14th of November, 2011,
retaining its position. Principal Secretary, Department of
Health and Medical Education, Government of Bihar,
Patna will remain physically present on that date along
with his show-cause.
