                            J U D G M E N T

The petitioner is presently working as a Reader in

the Department of Materia Medica in Government

Homoeopathic Medical College, Kozhikode. The petitioner has

submitted Ext.P1 representation for getting transfer to his

native District viz., to Thiruvananthapuram pointing out the

fact that he is due to retire on 30.4.2011 and that his date of

superannuation is 30.4.2010. The apprehension of the

petitioner is that the post of Reader available in Medical

College thiruvananthapuram will be filled up by granting

promotion to the 3rd respondent who is presently working as a

Lecturer in the Department of Materia Medica in Government

Homoeopathic Medical College, Thiruvananthapuram before

considering Ext.P1 representation submitted by the petitioner

carrying the request to transfer and post him against the post

of Reader in the Department of Materia Medica presently

available in Government Homoeopathic Medical College,

Thiruvananthapuram. Ext.P1 is dated 15.4.2010. Considering

the fact that Ext.P1 was submitted as early as on 15.4.2010,

and the same was forwarded by the controlling officer as per

Ext.P2, there will be a direction to the first respondent to

consider Ext.P1 before filling up of the vacancy available in

the category of Reader in the department of Materia Medica

in Government Homoeopathic Medical College,

Thiruvananthapuram and pass orders thereon, expeditiously,

at any rate, within a period of one month from the date of

receipt of a copy of this judgment.
