this special appeal is not maintainable in view of the judgment of
this Court in Hemendra Swaroop Bhatnagar (Now Deceased)
Vs. P.S. Gosain and others [2006 (10) ADJ 483 (DB).

In the light of that, this special appeal is dismissed. No order as to
costs.
