Background
1. The Commission received a complaint dt.24.9.09 from the Appellant regarding non-
compliance of CIC Decision of even No. dt.9.6.09.
The decision in the captioned case is as given below:
…. The Commission directs the CPIO to provide information against points 1, 5, 6 and 7 of
the RTI request and with regard to points 2, 3 and 4 the CPIO is directed to allow the
Appellant to inspect all the related files and to provide certified copies of the
information required by 10.7.09. All other information sought does not fall under the
definition of ‘information’ as given under Section 2(f) of the RTI Act.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for December 29, 2009.
3. Shri G.K.Rajnish, S.O representing CPIO and Shri Gya Prasad, Asstt. represented the
Public Authority.
4. The Complainant was present during the hearing.
Decision
5. The Complainant submitted that when he inspected the files, the information sought
was not available in them. It was his apprehension that the Respondents had
removed the documents before allowing the inspection and except for point 5, other
information is not available. He particularly wanted information with regard to points
4 and 6 of his RTI application.
6. The Commission after listening to the submissions made directs the PIO as follows:
i) to provide the date on which the ACR of Dr.Usha was received by the CHS
Division of Ministry between 16.12.92 and 27.8.93
ii) to inform whether Dr.Usha fulfilled the criteria for the post of Professor
specified as 4 years experience as Associate Professor as essential qualification
as notified vide OM dt.12.12.86 . (The starting date and ending dates of Dr.
Usha as Associate Professor may be provided).
7. The information to be provided to the Complainant by 30.1.2010 .
