By means of this writ petition, petitioner has challenged the impugned
transfer order dated 22.07.2008, by which he has been transferred from
Lucknow to Meerut.

This Court by means of order dated 28.08.2008 stayed the transfer
order.

Transfer is an exigency of service. Due to efflux of time, this writ
petition has become infructuous.

Writ petition is, therefore, dismissed as infructuous with the direction
that the opposite parties will not enforce the impugned transfer order
against the petitioner. It is, however, open for the opposite parties to
pass fresh order as per exigency of work.
