Prayer: This petition has been filed seeking for a writ of Certiorarified Mandamus, calling for the records pertaining to the impugned letter No.348/E2/IRT-PMC/2009 dated 03.02.2009 of the 3rd respondent, which is based on Circular No.076/E2/IRT-PMC/2009 dated 26.09.2008, quash the same and direct the 2nd respondent to accept the Application of the petitioner dated 22.01.2009 and consider the same for selection and admission to the P.G.Course-3 year (T.B. & Chest Diseases) for the academic year 2009-2010 after due process of examination. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.
2. At this stage of the hearing of the writ petition, the learned counsel, Mrs.Kala Ramesh, appearing on behalf of the respondents 3 and 4 had placed before this court a resolution of the Governing Council of the Institute of Road Transport, Chennai, which reads as follows:
“Resolved that the proposal of the Director, IRT to permit the doctors working at Perundurai Medical College and Hospital to apply for admission to P.G./P.G.Diploma Courses without any limit in the numbers of attempts as per the request of the High Court of judicature at Madras in M.P.Nos.1&2 of 2009 in W.P.Nos.3161 & 3162 of 2009 be and is hereby approved.”
3. However, the learned counsel had further submitted that the counseling for the selection and admission to the P.G. Course-3 year (T.B. and Chest diseases) for the academic year 2009-2010 has already been completed. The last date for the submission of the application for the said course was 30.01.2009. The entrance examination had been conducted on 22.02.2009. In such circumstances the petitioner’s application, dated 22.01.2009, could not be considered for the academic year 2009-2010. However, in view of the withdrawal of the restriction in the number of attempts, as per the resolution of the Governing Council of the Institute of Road Transport, Chennai, it would be open to the petitioner to apply for the said course for the ensuing Academic Year 2010-2011, if he is otherwise eligible.
4. The learned counsel appearing on behalf of the petitioner has not refuted the submissions of the learned counsel for the respondents 3 and 4.

In view of the submissions made by the learned counsels appearing on either side and in view of the resolution passed by the Governing Council of the Institute of Road Transport, Chennai, no further orders are required to be passed in the present writ petition. Hence, the writ petition stands closed. No costs. Consequently, connected Miscellaneous Petitions are closed.
6. However, it would be open to the petitioner to apply for the P.G. Course for the ensuing Academic Year 2010-2011, if he is otherwise eligible.
