In pursuance to the order dated 14.07.2010, the case has been
called out. No one appears for the petitioner.

Learned standing counsel was required to seek instructions as to
whether regularly selected candidates have been replaced the
petitioners.

Learned standing counsel states that in place of record, an
information has been received from the Director, Higher
Education, U.P. Allahabad, which is as follows:-

“1. That in reply to the first query it is submitted that Dr. Raj Deo
Dubey who was working as Mandey Lecturer Hindi is no longer
working in the said institution. In May, 2000 after being regularly
selected through U.P. Higher Education Service Commission, he
was placed in K.N.V.P.P.G. College, Tanda, Akbarpur and joined
the said institution. It is further submitted that the second
petitioner Dr. Om Prakash Dubey is still working as Mandey
Lecturer in Economics in Saltanat Bahadur P.G. College,
Badlapur, Jaunpur.

2. That in reply to the second query it is submitted that no
candidate regularly selected through U.P. Higher Education
Service Commission has been placed as yet in Saltanat Bahadur
P.G. College, Badlapur, Jaunpur in Economics.”

The writ petition, so far as the prayers for petitioner no. 1 is
concerned, has thus become infructuous. So far petitioner no. 2 is
concerned, he may have have a cause of action to pursue the
matter only if he is replaced by the regularly selected candidate by
the U.P. Higher Education Service Commission, or gets a right to
be considered for regularization by the Commission, in accordance
with law.

The writ petition is accordingly disposed of.
