This matter came up for hearing on 23.07.2008 pursuant to Commission’s
hearing notice dated 19.06.2008. Appellant was present in person, while the
respondents were represented by Mr.Faisal Imam, Senior Deputy Accountant
General (Admn) and Mr.P.S. Thakur, Assistant Accounts Officer.
2. Through his RTI-application dated 16.07.2007 appellant had demanded
from the respondents information regarding how and why the respondents ―
Accountant General (A&E) ― had determined certain receivables of the
appellant.
3. Respondents pointed out, that Accountant General determines the
receivables on the basis of the authorization given by the organization which an
employee serves ― in this case the State Government of Bihar. They cannot go
beyond the directions of the State government. According to them, the queries
which the appellant is directing towards the Accountant General ― the
respondents ― are better directed at the State Government of Bihar. According
to the respondents, it is a State Government’s matter and not the respondents’.
4. From the submissions heard from both sides, there is no doubt that the
respondents are right in stating that the matter brought up by the appellant
belongs to the domain of the State Government of Bihar and not the present
respondents. As such, this appeal is not within the ambit of any Central
Government Organisation which will bring it within the jurisdiction of the
Central Information Commission.
5. In view of the above, the appeal cannot be allowed. Closed.
6. Copy of this decision be sent to the parties.
