10 07-04-2011 Learned counsel for the petitioner in view of stand
taken in the counter affidavit submits that almost all the grievances
of the petitioner have already been redressed. However, still some
grievances, according to learned counsel for the petitioner, exist.
Learned counsel for the petitioner made a prayer for
passing an order in respect of the claim of the petitioner for merger
of 50 % Dearness relief on his basic pension. So far as merger of
50 % Dearness Allowance is concerned, the petition stands
allowed in terms of order dated 3.12.2010 passed in
C.W.J.C.No.3616 of 2010 ( Dr. Himanshu Bhushan Vs. T.M.
Bhagalpur University, Bhagalpur & Ors.). So far as remaining
claim of the petitioner is concerned, liberty is granted to the
petitioner to file a fresh representation before the Respondent no.2.
If such representation is filed by the petitioner, it is expected that

the same will be considered in accordance with law and
appropriate order will be passed within a period of three months
from the date of filing of such representation.
The petition stands disposed of with above
observation and direction.
