Background
1. The Appellant filed her RTI application dt.19.9.08 with the CPIO, ICMR. She
requested for information against 6 points with regard to SC/ST reservation
matters. The CPIO replied on 13.10.08, the gist of which is given below:
i) Reservation orders apply to appointments made to Scientific and
technical posts, upto and including the lowest grade of Group A in the
respective services. As the post of Director in Institutes/Centres under the
control of ICMR is a senior level Group A post, it is outside the purview of the
reservation orders. As such no reservation roster required to be maintained.
ii) As the reservation orders apply to appointments made to Scientific and
technical posts, upto and including the lowest grade of Group A in the
respective services, the question of approval letter for the exemption of ICMR
from the reservation orders does not arise.
Not satisfied with the reply, the Appellant filed an appeal dt.21.10.08 with the
Appellate Authority. On not receiving any reply, she filed a second appeal
dt.27.11.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for February 23, 2009.
3. Mr. V.K.Mehta, Sr. A.O. & CPIO, Mr. Joginder Pal, ADG and Mr. Harish Prasad,
S.O. represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Commission directs the CPIO to provide information regarding non
availability of letters against Point No.1 and 4 within 15 days of receipt of this
Order. Information against Point No.2, 3, 5 &6 has already been provided.
6. The appeal is disposed off.
