This writ petition has been filed against the order dated
5.2.2010, passed in Title Suit No. 13 of 1990, by learned Sub Judge-I,
Garhwa.
It is submitted that by the said order, learned court below
has directed the plaintiffs-respondents to furnish the account of the
Partnership Firm, whereas the same prayer was rejected on earlier
three occasions and moreover the said order is contrary to the
judgement dated 14.8.2006 and preliminary decree dated 28.8.2006.
The said submission of the petitioner is wholly
misconceived. The impugned order was passed on the petition filed
on behalf of the plaintiffs for preparation of final decree. After hearing
the parties, including the said submissions, the learned court below
has passed order for preparation of final decree in terms of the order
dated 14.8.2006, under which preliminary decree was passed in the
suit.
In my opinion, no grounds are made out for interference
with the impugned order in exercise of the powers conferred on this
Court under Article 227 of the Constitution of India.
Accordingly, this writ petition is dismissed. However, no
costs.
