Judgment

RAMAN, J.

Edamulakkal Service Co-operative Bank Ltd. is the

petitioner. The election to the Managing Committee of the said

Society is scheduled to be held on 16.08.2009. The petitioner

apprehends that unless police protection is ordered, there is

likelihood of the election being disrupted.

2. We have gone through the averments made in the Writ

Petition. Since the election is to be held to a co-operative

society, it is the duty of the State to see that such election is

conducted in a peaceful manner, without being interrupted by

anybody.

3. In the circumstances, we direct respondents 1 and 2 to

give necessary protection for the smooth conduct of the election

to the Managing Committee of Edamulakkal Service Co-

operative Bank Ltd., scheduled to be held on 16.08.2009.

4. Even though there is a prayer for permitting the

petitioner to videograph the process of election, we are not

granting any such permission in this Writ Petition. However, it is

open to the petitioner to seek permission from the Returning

Officer, if he is otherwise entitled to in law and if he is aggrieved

by any order passed by the Returning Officer, he may approach

the higher forum or this court by filing a Writ Petition.

5. The petitioner may produce a copy of this judgment

before respondents 1 and 2 for information and compliance.

The Writ Petition is disposed of as above.
