ORAL ORDER

Mr.Nirzar
Desai, learned Advocate for the petitioners does not press present
petitions. However, he has requested to grant some reasonable time to
vacate the premises more particularly to petitioner of Special Civil
Application No.13491 of 2008. Mr.Merchant, learned Advocate for the
common respondent has submitted that looking to the conduct of the
respective petitioners and considering the fact that respective
petitioners are already having their residence at Valsad, shortest
period of time be granted and that too on Undertaking. Under the
circumstances and in the facts and circumstances of the case, the
petitioners are granted time to hand over peaceful and vacant
possession of the suit premises to the respondent on or before 31st
December, 2008 without fail on usual Undertaking that they shall hand
over peaceful and vacant possession of the suit premises without any
hindrance to the respondent on or before 31st December,
2008 and that they shall not transfer, alienate and/or create any
charge on the suit property in the meantime and with a statement in
the Undertaking that if there is breach of said Undertaking then
straightway action be taken against them. Such an Undertaking to be
filed or before 21st November, 2008 with a copy to the
learned Counsel to the respondent. With these, present Special Civil
Applications are disposed of. Direct service is permitted.
