Mr.

Harin P. Raval, learned Assistant Solicitor General appearing for
the respondents prays for time. Other side has no objection. All
these petitions are, therefore, adjourned to 23.09.2008. Ad-interim
relief granted earlier shall continue till then.

So
far as Special Civil Application Nos.10444, 10445 & 10446 of
2008 are concerned, Mr. Keyur Gandhi, learned advocate appearing for
Nanavati Associates for the petitioners has filed speaking to minute
on 20.08.2008 pointing out that while passing the interim order on
14.08.2008, this Court has directed the petitioners to furnish bond
/ corporate surety and Bank guarantee of 10% of the supply value.
He has submitted that bond / corporate surety and Bank guarantee of
10% of the duty value is to be furnished as per the arrangement and
hence, instead of 10% of the supply value, it should be 10% of the
duty value.

In
that view of the matter, paragraph 4 of the order dated 14.08.2008
passed by this Court should be read as under :-

The
petitioners will furnish bond / corporate surety and Bank guarantee
of 10% of the duty value.

Office
is directed to modify the order to the above extent. This note for
speaking to minutes is accordingly disposed of.
