Rejoinder affidavit filed today is taken on record.
Heard learned counsel for the applicant and the learned A.G.A..
The applicant has been shown to have been recovered 150
grams of smack along with one country made pistol and some cartridges
from his possession. The alleged recovered smack is below commercial
quantity. It is pointed out by the learned counsel for the applicant that the
applicant has already been granted bail in case crime no. 24/10 under
section 307 IPC and case crime crime no. 27/2010 under section 3/25
Arms Act.
Considering the facts and circumstances of the case I am of the
view that it is a fit case of bail.
Let applicant Faqrey Alam be released on bail in case crime no.
28/2010 under sections 8/18/21 NDPS Act, P.S. Naka, District Lucknow
on his furnishing a personal bond and two sureties each in the like
amount to the satisfaction of the Magistrate/court concerned.
