Present
application seeks recalling of the order passed by this Court on
22/04/2010 whereby main matter being Special Civil Application
No.7804 of 1998 came to be dismissed for default.
It
is required to be mentioned here that while adjourning the matter on
31/03/2010 learned Advocate for the petitioner was directed to make
alternative arrangement, if he is not able to appear. However,
neither such arrangement was made nor anybody has mentioned the
matter on behalf of learned Advocate for the petitioner on
22/04/2010. It appears that learned Advocate for the petitioner is
not respecting the court proceedings and in that case it will not be
appropriate for this Court to respect the sick note of a lawyer.
Hence, no case is made out to recall the order. Application deserves
dismissal and is accordingly dismissed.
