                           J U D G M E N T

Balakrishnan Nair, J.

The petitioner has approached this Court alleging that when

she attempted to lay concrete slabs across a canal, so that she

will have access to 5 cents of land purchased by her in survey

No.212/5A of Kozhencherry Village, the 2nd respondent obstructed

the said work. The petitioner submits that she obtained

permission from the Assistant Executive Engineer, Minor Irrigation

Sub Division, Pathanamthitta for laying the R.C.C. slab across the

Lift Irrigation canal.

2. The learned Government Pleader upon instructions

submitted that earlier there was an attempt to open a road across

the canal without any permission from the Assistant Executive

Engineer and the police registered a crime against the then owner

of the property. After the purchase of the property, the petitioner

attempted to open a road to her property without the permission

of the concerned Engineer. The police interfered. Now, she has

obtained permission from the Irrigation Department, as per Exhibit P1.

The police will not interfere, if the work is done as allowed in Exhibit

P1. The learned Government Pleader also submitted that police have

no intention to harass the petitioner. The above submissions are

recorded and the writ petition is disposed of.
