Heard both sides. In view of the subsequent filing of M.A.T Appeal

NO.405/2007, wherein similar reliefs are prayed for, which is

pending, the writ petition has become infructuous. Hence, without

prejudice to the right of the petitioner to raise all his contentions

raised in this writ petition, in the appeal, the writ petition is dismissed

as infructuous.
