                     W.P.(C).No.36487/2008
     -----------------------------------------------------------
Dated this the 11th day of December, 2008

                            JUDGMENT

Petitioner was working as HSA in NSS High School

Pullikkanakku and on attaining the age of superannuation he

retired from service, with effect from 31.3.2007. According

to him, his terminal benefits have not been released. While

he was raising complaints in this behalf, on the direction of

the 3rd respondent, the 4th respondent, reduced his pay

without putting him on notice or hearing him. It is also his

case that, based on the said order, liability certificate was

issued by the 3rd respondent and DCRG was reduced by

Rs.35,598/-.

2. According to the petitioner he has filed Ext.P7

before the second respondent complaining against the

reduction of DCRG and prayed for release of benefits. In

WP(c).No.36487/08 2

this writ petition what is complained of is the inaction of the

2nd respondent on Ext.P2.

3. In the nature of the compliant that the petitioner

has, I am satisfied that his grievance deserves to be

considered by the 2nd respondent. Since the petitioner has

filed Ext.P7 before the 2nd respondent in this behalf, it is

directed that the 2nd respondent shall consider and pass

orders thereon,if the same has been received and is

pending. This shall be done as expeditiously as possible and

at any rate within 8 weeks from the date of production of a

copy of the judgment.

Petitioner shall produce a copy of the judgment along

with a copy of the writ petition before the 2nd respondent

for compliance.
