ORDER
1. Heard
learned advocate Ms.Nisha Parikh for the applicant and learned
advocate Mr.M.J.Shelat for the Insurance Co.
2. This
Court has issued Rule on 17.7.2008 making it returnable on 13.8.2008.
Except respondent No.5, all the respondents have been served with
notice of Rule. However, no appearance is filed by them and no
advocate is engaged by them. Therefore, in their absence, the matter
is taken up for hearing.
3. Present
application has been filed with a prayer to condone the delay of 189
days caused in preferring the application for indigent person.
3. I
have considered the averments made in this application on affidavit
and the submissions made by learned advocate Ms.Parikh. Sufficient
cause has been shown by the applicant for condonation of delay of
189 days in preferring the application for indigent person.
Therefore, delay of 189 days caused in preferring application for
indigent person has been condoned as same is sufficiently explained
to the satisfaction of this Court. Accordingly, Rule is made
absolute to that extent.
